Exceptions to the right of withdrawal (L.2251 / 1994 A.31B)

In accordance with Article 31b of Law 2251/1994, the following cases are excluded from the right of withdrawal:

 

(a) service contracts after full service, if the execution commenced with the prior express consent of the consumer and by his acknowledgment that he would lose his right of withdrawal once the contract has been fully executed by the supplier;

(b) the supply of goods or the provision of services the price of which depends on fluctuations in the money market which the supplier can not control and which may occur within the withdrawal period;

(c) the supply of goods manufactured according to consumer specifications or clearly personalized;

(d) the supply of goods which may be altered or expire soon;

(e) the supply of sealed goods which are not suitable for return for reasons of health or hygiene and which have been unsealed after delivery;

(f) the supply of goods which, by reason of their nature, are, by their nature, inseparably mixed with other items;

(g) the supply of alcoholic beverages, the price of which has been agreed upon at the time of the conclusion of the contract of sale, the delivery of which may be effected only after 30 days and the actual price of which depends on fluctuations in the market, it is possible for the supplier to check;

(h) contracts where the consumer has requested a special visit from the supplier for the purpose of carrying out urgent repairs or maintenance work. If, in the event of such a visit, the supplier provides services in addition to those specifically requested by the consumer or goods in addition to the spare parts necessarily used in the course of maintenance or repairs, the right of withdrawal applies to such additional services or goods;

(i) the supply of sealed sound recordings or sealed video recordings or sealed computer software, which have been unsealed after delivery;

(j) the supply of newspapers and magazines of all kinds, excluding subscription agreements for the supply of these forms;

(k) contracts awarded by public auction;

(l) the provision of accommodation other than for the purpose of residence, transport of goods, car rental services, catering or services related to leisure activities, if the contract provides for a specific date or time-limit;

(m) the supply of digital content not provided on a physical medium if the execution has begun with the prior express consent of the consumer and his confirmation that he is losing his right of withdrawal.
